Article 1 – Definitions

M25 Watches B.V.: the company established in Maastricht, operating under the name M25 Watches B.V., registered with the Dutch Chamber of Commerce.

Counterparty: any natural or legal person who enters into an agreement with M25 Watches B.V., whether a consumer (B2C) or a business customer (B2B).

Consumer: a natural person who acts for purposes outside his or her trade, business, or profession.

Business Customer (B2B): a natural or legal person acting in the course of a trade or business.

Client: the Counterparty, whether consumer or business customer.

Products: watches, jewellery, accessories, and other goods sold or consigned by M25 Watches B.V.

Online Platform/Webshop: the website(s) of M25 Watches B.V. and third-party platforms through which sales take place.

Agreement: any form of sales, delivery, repair, maintenance, or consignment agreement.

Article 2 – Applicability

  • These terms and conditions apply to all offers, orders, repairs, consignment agreements, and purchase and sales agreements with M25 Watches B.V.
  • Any deviating terms of the Counterparty are expressly rejected unless otherwise agreed in writing.
  • By confirming an order, assignment, or agreement, the Counterparty accepts these general terms and conditions.

Article 3 – Quotations and Formation of the Agreement

  • All quotations and offers are without obligation unless expressly stated otherwise in writing.
  • An agreement is concluded:
    • B2C: by acceptance through the online ordering process or in-store purchase.
    • B2B: by written or electronic confirmation of the order or assignment by M25 Watches B.V.
  • M25 Watches B.V. reserves the right to refuse an order or to attach conditions to delivery, for example in cases of payment uncertainty, availability issues, or suspected fraud.
  • If an order cannot be fulfilled, the Counterparty will be informed as soon as possible. Any payments made will be refunded in full.

Article 4 – Prices

  • All prices are in Euros, including VAT for consumers, unless stated otherwise.
  • M25 Watches B.V. reserves the right to adjust prices in the event of fluctuations in cost factors or statutory obligations.
  • Errors in price quotations may lead to cancellation of the order without M25 Watches B.V. being liable for any damages.

Article 5 – Payment

  • Payment may be made by bank transfer, iDEAL, or other payment methods accepted by M25 Watches B.V.
  • For online purchases, delivery will take place only after full payment has been received.
  • For business customers, a deposit or security may be required.
  • In case of late payment, the Counterparty is in default by operation of law and owes:
    • Consumers: statutory interest.
    • Business customers: 1% per month, unless higher by law.
  • Reasonable collection costs shall be borne by the Counterparty.

Article 6 – Delivery and Risk

  • Delivery takes place at the address provided by the Counterparty or may be collected in-store.
  • The risk of loss or damage passes to the Counterparty once the product has been made available.
  • Ownership remains with M25 Watches B.V. until all obligations under the agreement have been fulfilled.
  • In case of consignment, ownership remains with the Counterparty unless otherwise agreed.

Article 7 – Right of Withdrawal (Consumers)

The consumer has the right to withdraw from the purchase within 14 days after receipt without giving any reason. The withdrawal period starts on the day the product is received. For multiple products in one order, the period begins when the last product has been received.

To exercise the right of withdrawal, the consumer must send an email to info@m25watches.com or complete the return form on our website within 14 days of receipt, clearly stating the wish to withdraw from the purchase.

After withdrawal, the product(s) must be returned within 14 days according to the return instructions. Return shipping costs are borne by the consumer unless stated otherwise.

During the reflection period, the consumer may handle or try on the product only as would be allowed in a physical store. Wear or usage marks may result in depreciation for which the consumer is liable.

The product must be returned complete, unworn, undamaged, and—where reasonably possible—in its original packaging. The risk of return shipment lies with the consumer until receipt by M25 Watches B.V.

After receipt and inspection of the returned product, M25 Watches B.V. will refund the purchase amount (excluding shipping and return costs) within 14 days using the same payment method as used for the order. We may withhold reimbursement until the product has been received and inspected.

Products that cannot be returned for hygiene reasons (such as worn or opened items, or products with broken seals) are excluded from the right of withdrawal.

Article 8 – Security Deposit, Cancellation, and Purchasing

  • M25 Watches B.V. may require a deposit or other security up to a maximum of 50% of the purchase price.
  • In case of cancellation of specially ordered products, cancellation fees apply depending on the timing (10–60%).
  • For products purchased from third parties or consumers, a reasonable compensation of 25% of the purchase amount may be charged in the event of cancellation or non-collection.
  • For uncollected repairs or orders, provisions apply regarding storage, sale, and cost settlement.

Article 9 – Warranty and Exclusions

  • The warranty on watches and jewellery is:
    • New products: 12 months.
    • Repaired products: 3 months on the repaired components.
  • The warranty does not apply in cases of:
    • Normal wear and tear.
    • Damage resulting from accidents, modifications, negligence, or improper use.
    • Water damage, unless the product is specifically classified as water-resistant and the defect falls within the specified water resistance rating.
  • The warranty applies only if the product has been used and maintained properly.

Article 10 – Liability

  • The liability of M25 Watches B.V. is limited to direct damage and to the value of the relevant product.
  • M25 Watches B.V. is not liable for indirect, consequential, or incidental damages.
  • Where insured, the insurance payout serves as the maximum limit of liability.

Article 11 – Intellectual Property

  • All intellectual property rights to designs, photos, images, drawings, and models of M25 Watches B.V. remain the property of M25 Watches B.V.
  • It is prohibited to copy, use, or disclose these without prior written permission.

Article 12 – Force Majeure

  • M25 Watches B.V. is not liable for non-performance due to force majeure, including but not limited to pandemics, war, fire, storms, strikes, transport disruptions, or supplier issues.
  • In the event of force majeure, M25 Watches B.V. may suspend or terminate the agreement without any obligation to pay compensation.

Article 13 – Privacy

  • Personal data is processed in accordance with the GDPR and the privacy statement available on the website of M25 Watches B.V.
  • Newsletter subscriptions are opt-in and can be cancelled at any time.

Article 14 – Final Provisions

  • If any provision is found to be invalid or void, the remainder of these terms shall remain in full effect.
  • All agreements are governed exclusively by Dutch law.
  • Disputes shall, insofar as permitted by law, be submitted to the competent court in Maastricht.

Annex: Right of Withdrawal Overview

  • Withdrawal period: 14 days after receipt of the product.
  • Exclusions: Personalized items, hygiene-sensitive products, and products damaged through use.
  • Return costs: To be borne by the consumer unless otherwise agreed.
  • Refund: Within 14 days after receipt of withdrawal notice.

Annex: Online and In-store Sales

  • Online Sales: Subject to the right of withdrawal and consumer protection laws.
  • In-store Sales: No right of withdrawal unless otherwise agreed.
  • Consignment: Ownership remains with the Counterparty until the product is sold; risk transfers upon receipt by M25 Watches B.V.

Annex: Repairs and Maintenance

  • Repair warranty: 3 months on the repaired components.
  • Quotation: Required for repairs exceeding €50.00.
  • No approval of quotation: Inspection costs may be charged.
  • Uncollected repairs: Storage costs may apply; after a certain period, the product may be sold to cover costs.

Annex: Purchase of Products

  • Identification: Required when purchasing watches or jewellery from consumers.
  • Transfer of ownership: Ownership transfers upon receipt of payment.
  • Consignment: Product remains the property of the Counterparty until sold.
